We understand your desire to avoid unsolicited solicitations and appreciate your right to keep your personal information private. We, along with banks, brokerage houses, and other financial organizations, are now required by law to provide you with our Customer Privacy Policy, which we are more than glad to do. Customer further acknowledges, accepts, consents, and agrees that Shepard may, at any time and without previous notice or cause, amend, modify, or otherwise change the customer privacy policies on the website (collectively, “Changes”) at its sole and absolute discretion. All changes will become part of this agreement as soon as Shepard posts them on the website, and the customer hereby acknowledges, accepts, consents, and agrees to any and all changes instantly and unreservedly. The customer acknowledges, consents, accepts, and agrees that they will examine the customer privacy policies on the website on a regular basis to ensure that they are aware of any changes. If any of the changes are not totally acceptable and agreeable to the customer, the customer should stop using and accessing the website immediately.
- Information that Shepard Collects on the website
Shepard may obtain the following information from the customer: first and last names, street address, city, state, zip code, cross streets, phone number, email address, location (e.g., via GPS), and credit card or other payment information. Shepard may also collect information about the customer’s use of the website, as well as the customer’s preferences, questions, and opinions about Shepard’s products and services that the customer may reveal or otherwise supply. This data is referred to as “Personally Identifiable Information,” or “PII.” Third-party merchants and others may collect PII that the customer provides from time to time through the Shepard website.
Shepard may gather aggregated information about access and usage in addition to PII that reflects but does not expose either the customer’s or other people’s individual PII. This comprises demographic, computer profile, and statistical information. This data is referred to as “Non Personally Identifiable Information,” or “Non PII.”
Information, text, images, photographs, video, audio, graphics, branding, logos, content, material, software, code, interface, products or services (collectively, “Customer Content”) that may contain PII and other personally identifiable information about the customer may be posted or otherwise submitted to the website, or to or through social website that may be linked to the website, from time to time. By posting or otherwise submitting customer Content containing PII or other personally identifiable information to the website or to or through social media websites that may be linked to the website, the customer consents to such PII and other personally identifiable information being published and disclosed.
Children under the age of 18 are not permitted to use the website. You confirm that you are 18 years of age or older by watching, accessing, browsing, responding to or submitting content to, or otherwise using the website, or by viewing, accessing, browsing, replying to, purchasing, or otherwise using any service or product provided by or referenced in the website. Shepard does not collect information from children under the age of 18 without their consent.
- Shepard’s Use of Information it Collects on the website
Shepard uses PII in a variety of ways from time to time. Shepard utilizes PII to communicate with customers about Shepard policies and procedures, as well as updates to Shepard rules and procedures; customer PII and Non-PII; and Shepard products and services that the customer may express interest in or select, and to advise and bring to the customer’s attention products and services that may in the future be offered by or through Shepard. This may also involve allowing the customer to create, edit, publish, and disseminate communications related to Shepard’s products and services. Shepard also uses PII to allow customers to open accounts and place orders and other transactions, as well as to assist with the completion and execution of those orders and transactions.
Shepard uses Non-PII in a variety of ways from time to time. Non-PII is used by Shepard to measure and analyze site access and usage, as well as to administer, improve, and enhance the website, as well as the products and services offered by Shepard through or through the website.
- Shepard’s Disclosure of Information it Collects on the website: Routine
Shepard may share PII with its affiliates and third parties in order to accept, process, and execute an order or other transaction, as well as vendors and service providers who help with the creation, deployment, improvement, hosting, and administration of the website. Shepard may also provide the customer’s information, including PII, to third-party merchants and service providers, such as third-party marketplace operators that sell Shepard’s products and services (collectively, “Partners”), in order for those third-party Partners to optimize Shepard’s marketing campaigns, such as, but not limited to, social media marketing, direct mailing, and direct email marketing towards the customer. Shepard may also share the customer’s information, including PII, with its Partners in order for those Partners to contact the customer about their products and services, including, but not limited to, via direct email from the Partners to the customer. By accessing or using the website, the customer expressly acknowledges and consents to Shepard and its Partners’ use of the customer’s information, including the customer’s PII. If the customer wishes to opt out of such usage of their PII or to prevent Shepard from sharing their information with Shepard’s Partners, they may do so at any time by sending an email to privacy@Shepard.com. Shepard will grant all such requests.
Shepard discloses Non PII from time to time to its affiliates and third parties as it shall determine in its sole and absolute discretion.
- Shepard’s Disclosure of Information it Collects on the website: Non Routine
Shepard reserves the right in its sole and absolute discretion to disclose PII and Non PII (a) in connection with a merger or sale of Shepard , or all or any portion of its assets or equity; (b) in connection with any bankruptcy, reorganization or similar proceeding involving Shepard, (c) as may be required by applicable laws or regulations of any international, national, federal, or local government or governmental body; or (d) to comply with legal process including, without limitation, any order, requirement or request of any court or other judicial body; or (e) as Shepard shall determine in its sole and absolute discretion to defend, protect and secure its property, rights, business, operations, or other rights.

The website may display, provide, refer to, or contain links to third-party websites at any time and from time to time. Shepard bears no responsibility for the privacy practices of any third party, including, without limitation, such webwebsite, and this Privacy Policy does not extend to, cover, or in any way address them. Shepard does not represent, warrant, or ensure the privacy of customer PII and Non PII by giving access to such webwebsite. The customer’s access and use of such links and websites is and will always be at his or her own risk, including without limitation with respect to the customer’s PII and Non-PII.
- Shepard’s Protection of Customer PII
Shepard has built its website to meet industry requirements for security and PII protection. Regardless, there is a significant danger that PII will not be kept private when using the internet or computers. As a result, Shepard cannot guarantee or ensure that customer PII will remain private.
- Accessing and Correcting customer PII; Opt-Out
A customer has the right to obtain a copy of the personally identifiable information (PII) that Shepard maintains about them. Customers should email Shepard at privacy@Shepard.Com to request a copy. For this service, Shepard may charge a reasonable fee. Shepard may be asked to alter or delete information that the customer believes is incorrect. Any of a customer’s profile information can be changed by utilizing the “Edit” option on the website’s profile settings page.
A customer may decide that he or she no longer wants to receive Shepard’s emails. Customers can change this by going to the website’s profile settings page and utilizing the “Edit” function.
